Terms of Service
Welcome to Sewzee, an online marketplace for tailors, boutiques, and laundry services, developed and operated by AR Stichit Pvt Ltd ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Sewzee app (the "App").
By accessing or using the App, you agree to be bound by these Terms, which constitute a binding legal agreement between you and AR Stichit Pvt Ltd. If you do not agree to these Terms, you may not use the App.
User Accounts
In order to use certain features of the App, you may be required to create an account. You are solely responsible for maintaining the confidentiality and security of your account information, including your username and password. You agree to notify us immediately if you suspect or become aware of any unauthorized use of your account or any other breach of security.
You are responsible for all activity that occurs under your account, including any activity by unauthorized users. We reserve the right to suspend or terminate your account, or to require you to change your username or password, at any time for any reason.
Use of the App
The App is an online marketplace for tailors, boutiques, and laundry services. You may use the App to browse and order products and services from third-party vendors, including tailors, boutiques, and laundry services. You must be at least 18 years old to use the App.
Registration
To use certain features of the App, you may be required to create an account and provide certain personal information. You agree to provide accurate and complete information when registering for an account, and to keep your account information up-to-date. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
Content
The App may contain user-generated content, such as product listings and reviews. You agree not to post, upload, or transmit any content that:
· Infringes any third-party intellectual property rights, including copyright, trademark, or patent rights.
· Contains viruses, Trojan horses, worms, or other harmful code.
· Is false, misleading, or deceptive.
· Is defamatory, obscene, or offensive.
· Violates any applicable laws, regulations, or these Terms.
You grant AR Stichit Pvt Ltd a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, display, reproduce, modify, and distribute your user-generated content in connection with the App and AR Stichit Pvt Ltd.’s business operations.
Payment Terms
If you use the App to make a purchase, you agree to pay all fees and charges associated with your purchase, including any applicable taxes. You authorize us to charge your chosen payment method for any such fees and charges.
We may use third-party payment processors to facilitate payments on the App. Your use of such payment processors is subject to their respective terms and conditions.
All transactions are final and non-refundable, except as otherwise provided in our refund policy or as required by applicable law.
Cancellation and Refunds
You may cancel your order before it is fulfilled by the vendor. If you cancel an order after it has been fulfilled, you may not be entitled to a refund, as determined by the vendor. AR Stichit Pvt Ltd is not responsible for any refunds or cancellations.
Intellectual Property
The App and its contents, including without limitation all text, graphics, images, software, and other materials, are the property of AR Stichit Pvt Ltd or its licensors and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the App for your personal, non-commercial use only. You may not copy, modify, distribute, sell, or lease any part of the App or its contents, nor may you reverse engineer or attempt to extract the source code of the App.
The Sewzee name and logo are trademarks of AR Stichit Pvt Ltd, and may not be used without our prior written consent.
Liability and Disclaimers
The App and its contents are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement.
AR Stichit Pvt Ltd and its affiliates, officers, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App, whether or not we have been advised of the possibility of such damages.
Idemnification
You agree to indemnify and hold harmless AR Stichit Pvt Ltd and its affiliates, officers, employees, agents, and licensors from any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in connection with your use of the App or your breach of these Terms.
Termination
AR Stichit Pvt Ltd may terminate or suspend your access to the App at any time, with or without cause, without prior notice or liability to you. Upon termination, you must immediately cease all use of the App and destroy any copies of the App in your possession.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or your use of the App shall be resolved exclusively through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in the English language and shall take place in Mumbai, India.
Modifications to Terms
AR Stichit Pvt Ltd may revise these Terms from time to time, in its sole discretion, by posting the updated Terms on the App. Your continued use of the App following the posting of any changes to the Terms constitutes your acceptance of such changes.
Miscellaneous
These Terms constitute the entire agreement between you and AR Stichit Pvt Ltd with respect to your use of the App and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and AR Stichit Pvt Ltd.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
You may not assign or transfer these Terms, or any of your rights or obligations hereunder, without our prior written consent. We may assign or transfer these Terms, or any of our rights or obligations hereunder, without restriction.
